Carter Co. man convicted in 2012 vehicular homicide case to get new trial

CARTER COUNTY, TN (WJHL) – A Carter County man convicted of vehicular homicide in a 2012 crash won his appeal for a new trial earlier this week.

Micah Cates was sentenced to eight years in prison in March 2014 for the death of Tanner Perkins, who was killed when Cates wrecked on Milligan Highway in August 2012.

Prosecutors said Cates had been drinking the night of the crash.

At trial, the state used a blood draw from Cates that was obtained without a warrant.

That warrantless blood draw was the basis for Cates’ appeal.

The Tennessee Court of Criminal Appeals issued the ruling Monday, throwing out the conviction and granting a new trial.
